ALVIS
§ 1 DEFINITIONS
1. Service Provider - Animal care service ALVIS running a business under the name ALVIS Limited Liability Company with its registered office in Gdańsk, ul. Ogarna, 117/118, room 2, 80-826, entered into the register of entrepreneurs of the National Court Register under KRS number 0000797420, NIP 9571117734, REGON 384010073.
2. Recipient / Customer - the owner of the animal entrusted to the care of the animal or a person who is not the owner of the animal, who has the full right granted by the owner to put the animal under the care of a guardian / petsitter.
3. Guardian / Petsitter / Leading - a person who, on behalf of the Service Provider, deals with the animals entrusted to their care.
4. Animals / Animal - pets (dog, cat, hamster, fish etc.).
5. Regulations for the care of animals / Agreement for the provision of services - this document specifying the rules for the provision and use of services provided by the Service Provider to the Service Recipients via the Website as well as the rights and obligations of the Service Recipient and the Service Provider.
6. Website - an internet platform enabling the conclusion of contracts for the provision of services offered by the Service Provider, run by the Service Provider, available via the URL https://www.dog-walk.pl
7. Services - all services provided by the Service Provider to the Service Users, in particular, a dog walking service, a service for caring for animals at the Customer's or Guardian's home, etc.
8. Subscription - a package of 12 and more / 20 and more / 30 and more walks or visits to the animal at a reduced price compared to the price of a single walk / visit, after paying for which the Customer can use the purchased services within 365 days from the first day walk / visit. After 365 days from the date of the first walk / visit, the Subscription / Package expires, the funds for unused services are not refundable.
9. Pro forma invoice / Invoice - a document that is a proposal for the Client, sent as a form of a request for payment.
§ 2 GENERAL PROVISIONS
1. These Regulations (hereinafter referred to as the Regulations) define the detailed conditions and rules for the use of animal care services by ALVIS - an animal care service running a business under the name ALVIS Sp. z o.o. with headquarters in Gdańsk (80-826) at ul. Ogarna, 117/118, lok. 2, hereinafter also referred to as the Service Provider.
2. The regulations define the rules of caring for animals.
3. The care for animals is carried out by the Service Provider and / or persons designated by him - Pets Sitters / Guardians, on which the Service Recipient agrees.
4. An integral part of this Agreement for the provision of services is the questionnaire completed by the Customer posted on the website https://www.dog-walk.pl and the price list on the website https://www.dog-walk.pl.
5. The parties to the Agreement for the provision of services are the Service Provider and the Service Recipient / Customer.
6. You can place orders 24 hours a day via the website https://www.dog-walk.pl. Orders placed after 5:00 p.m. on weekdays, on Saturdays, Sundays and public holidays will be processed in the order of applications from 9:00 a.m. on the next business day.
§ 3 OBLIGATIONS AND RIGHTS OF THE SERVICE PROVIDER
1. The Service Provider is responsible for the performance of the Service Agreement by the Guardian.
2. The Service Provider guarantees that the Pet sitters he employs have been carefully checked and properly trained in the care of animals. The service provider confirms that all caretakers of the Alvis pet care service are warned about financial, administrative and criminal liability and instructed about the rules of conduct at the customer's home when caring for the animal (the guardian is not allowed to hand over the keys to the customer's home to third parties without the customer's consent, admit or invite third parties to the Customer's home, make copies of keys, use the Customer's home for any other purpose not related to caring for the animal, smoke, use alcohol and / or drugs, etc.).
3. In the absence of a suggestion from the Customer, the Service Provider will, at its sole discretion, select the location of the walk, taking into account its duration.
4. The Service Provider undertakes in particular to:
4.1. ensuring the best possible care for the animal, caring for its health and safety,
4.2. provide the animal with the right amount of movement for it, form of play based on previous suggestions and arrangements with the client,
4.3. providing information about the observed disease symptoms or abnormal behavior of the animal during a walk or care,
4.4. not to walk the dog to school fields, playgrounds, sandboxes, beaches and bathing areas as well as other areas and facilities where such a ban is in force,
4.5. immediately provide information on the health of the animal in the event of body injury, bite, disease or death. If a damage occurs, the Service Provider is obliged to immediately notify the Customer about it and to take all reasonable measures to secure it and prevent its further increase,
4.6. not using aggressive stimuli towards the dog.
5. Service Provider:
5.1. is entitled to refuse to accept an animal or to resign from performing the service in a situation where the animal may pose a threat to the health or safety of other people or animals, in particular when it is aggressive and does not have valid vaccinations and protection against ticks, in heat, in heat, etc. and is not wormed,
5.2. is not responsible for the animal's disease which is not the fault of the Service Provider,
5.3. in the case of dogs considered aggressive pursuant to the Regulation of the Minister of Internal Affairs and Administration of April 28, 2003, during the walk, the Service Provider undertakes to walk the dog in a muzzle provided by the Service Recipient.
5.4. The service provider is not responsible for random events involving the animal,
5.5. The service provider is not responsible for the destruction of items belonging to the animal - the same in the case of their accidental destruction by the guardian and their destruction by the animal. If a given item is valuable, please do not hand it over for care.
5.6. The Service Provider is not responsible for biting the Customer's dog by another dog walking without a leash. According to the law, in the case of a dog bitten by a dog, the law presupposes the responsibility of the guardian of the attacking animal.
6. The Service Provider undertakes to clean up dog droppings left behind by the animal.
7. The Service Provider undertakes to provide a report on the service provided by e-mail (provide a tracker with the route and km of the walk, photos or video, description of the pet's behavior and well-being).
§ 4 OBLIGATIONS AND RIGHTS OF THE SERVICE RECIPIENT
1. The Service Recipient undertakes in particular to:
1.1. inform the Service Provider about the actual health condition of the transferred animal, including information about any ailments of the animal and ways to minimize the discomfort felt by the animal (e.g. limiting physical activity, walking up stairs),
1.2. show the animal's health booklet or a certificate of current vaccinations, administered to the animal anti-parasitic agents, its physical and mental health condition and confirmation that the animal does not suffer from any infectious diseases,
1.3. timely collection of the animal, i.e. collection at the agreed place and time. In a situation where the Service Recipient does not contact the Service Provider and fails to comply with the conditions set out in the Regulations within 3 hours after the deadline for receipt, §7 of these Regulations will apply.
1.4. provide a leash and a muzzle (in the case of dogs considered aggressive), food for the entire period of care and toys for animals,
1.5. providing the Service Provider with reliable and complete information about the animal,
1.6. covering the costs of veterinary treatment of the entrusted animal, which were incurred by the Service Provider, and which were not caused by his fault.
2. The Service Recipient declares that:
2.1. acknowledges that the animal during exercise and playing during a walk (including with other dogs) may be injured and will not make any claims against the Service Provider,
2.2. agrees to a visit to the attending physician or, in the event of his absence, or the inability to perform the service, by the doctor indicated by the Service Provider at his expense,
2.3. agrees to the use of special equipment for walking the dog. Each Caregiver has special equipment: a collar, leash and belt that will never tear and are attached to each other with climbing carabiners. Therefore, we can guarantee that the dog will not run away.
If the Service Recipient does not agree to the use of special equipment to walk the dog, the Service Provider is not responsible for the dog escaping and the consequences resulting therefrom.
3. The Service Recipient bears full responsibility for damages caused by the animal to people, other dogs or property.
4. Each time we ask for information by e-mail, WhatsApp or Messenger with the list of items transferred with the dog for care to our guardian. The service provider is not responsible for the items handed over to the guardian and not returned in a situation where he does not have information about the handover of the item. In the event of receiving a list of items, checking them by the guardian during the transfer of the animal and not returning one of them, the funds equivalent to the missing item will be refunded.
5. The Service Recipient undertakes to comply with these Regulations.
6. Disputes between the parties will be settled by the courts competent according to the provisions of Polish law.
§ 5 PAYMENTS AND PERFORMANCE OF THE SERVICE
1. The Service Recipient shall pay to the Service Provider the remuneration resulting from the issued Invoice to the bank account indicated in the Invoice.
2. By paying for the services, the Client declares that he has read the Regulations and accepts all the conditions contained therein.
3. The Service Recipient may make a prepayment of the entire value of the order by transfer to the Service Provider's bank account.
4. The amount of care for the service provided is determined on the basis of the price list applicable at the time of concluding the Agreement. The price list of services is available on the website of the Service Provider https://www.dog-walk.pl
5. The payment is considered made when the funds are credited to the Service Provider's bank account.
6. The date of receipt of funds on the Service Provider's bank account is the date of the Agreement.
7. The Parties agree that additional services related to the implementation of this Agreement (eg animal's visit to a veterinarian, visit to a hairdresser, care for several animals, etc.) are subject to agreement in the Invoice. The Customer will be informed about each additional fee determined by the Service Provider by e-mail or by phone.
8. In the event of shortening the period of care and / or resignation from services, the fee paid by the Customer is not refundable, subject to the provisions of §8 of these Regulations.

10. The Service Provider is not responsible for the actions or omissions of the websites through which the user decided to make the payment.
11. The right to withdraw from a distance contract does not belong to the consumer if the cancellation of the service occurs 3 hours before the date on which it was supposed to be performed or if the cancellation of the service (which was supposed to be performed by 12: 00) occurs on the day preceding its performance and after the working hours of the customer service department.
§ 6 DESCRIPTION OF SERVICES AND ORDER FULFILLMENT
1. The order processing time is counted from the moment of receiving the questionnaire completed by the Customer on the website www.dog-walk.pl, providing all the necessary information and contact details of the Customer.
2. First walk + familiarization - 45 min. - this is getting to know the dog and its Guardian. Includes 15 minutes to get acquainted and a 30-minute walk. The first walk of the dog with a walker should take place in the presence of the dog's owner - this will protect the animal from stress.
3. Walk with the dog 30 minutes - includes 20-25 minutes of the actual walk and 5-10 minutes for organizing the service (pick up the dog, return the dog from the walk, wash the dog's paws, feed it if needed, play etc.).
4. Walk with the dog 60 minutes - includes 50-55 minutes of the actual walk and 5-10 minutes for organizing the service (pick up the dog, return the dog from the walk, wash the dog's paws, feed it if necessary, play, etc.).

5. Walk with the dog 90 minutes - includes 80-85 minutes of the actual walk and 5-10 minutes for organizing the service (pick up the dog, return the dog from the walk, wash the dog's paws, feed it if necessary, play etc.).
6. Walk with the dog 2 hours - includes 110-115 minutes of the actual walk and 5-10 minutes for the organization of the service (pick up the dog, return the dog from the walk, wash the dog's paws, feed it if necessary, play etc.).
7. A walk with more than one dog is payable additionally if the group walk is comfortable for dogs and Petsitters. The Service Provider may refuse the Client a group walk of dogs if such a walk is not safe for the health and life of the dogs or Petsitter (large dogs, dogs that require more attention during the walk, etc.).
8. Taking care of a dog or cat at the Caregiver's house - it is a 24-hour stay of the pet at the Caregiver's house, but it is not a 24-hour stay of the Caregiver with the animal, i.e. the Petsitter takes care of the pet (regularly feeds it, walks it, plays with it, etc. ), but may leave your pet alone for several hours. Dog care includes the number of walks depending on the type of care purchased and the dog's needs. It is better if the owner of the animal (the Service Recipient) brings and picks up his pet to and from the Caregiver himself - this will reduce the animal's stress.
It is possible to have a pet in and out from 7.00 a.m. to 9.00 p.m. The beginning of care is the day and time of receipt of the pet. The day and time of picking up the pet from the Guardian are considered as the end of the care service.
The Service Recipient may pick up the animal before the agreed date of the end of care (only from 7:00 a.m. to 9:00 p.m.) after prior contact with the Service Provider at least 2 hours prior to collection.

9. Care at the Caregiver's home for additional animals is paid additionally.
10. In the event of delay in collecting the animal by the Customer at the time and place agreed in advance, the Customer will pay the Service Provider additional remuneration (determined based on the amounts resulting from the price list), this applies to a delay of more than 30 minutes from the scheduled time of collection.
11. In the event of delay in collecting the animal:
11.1. The Service Recipient undertakes to inform the Service Provider by phone about the inability to collect the animal no later than 30 minutes before the agreed time of collection. If there is no contact for more than 3 hours
The Service Provider reserves the right to place the animal in a different place (including an animal shelter), and the Service Recipient agrees to provide personal data. If the animal is placed elsewhere, the Service Provider will inform the Customer by phone or e-mail about the address details.
11.2. for reasons attributable to the Service Provider, he undertakes to inform the Customer by phone about the impossibility of arriving on time and the scheduled time of the meeting.
12. Taking care of animals at the customer's home - these are visits of 20.60, 90 and 120 minutes:
12.1. Visit 20 min. - it is a short visit to feed the pet, play with it, make sure it is okay, clean the litter box. Walking the dog is not included.
12.2. Visit 60 min. - it is a visit to feed the pet, play with it, make sure that it is all right, clean the litter box and, if necessary, go for a 30-minute walk.
12.3. Visit 90 min. - it is a visit to feed the pet, play with it, make sure that it is all right, clean the litter box and, if necessary, go for a 30-minute walk.
12.4. Visit 120 min. - it is a visit to feed the pet, play with it, make sure that it is all right, clean the litter box and, if necessary, go for a 30-minute walk.
13. 1 consecutive hour of care (without walking) - this is each subsequent hour of caring for the animal between 8.00 - 21.00.
14. Staying overnight (no more than 10 hours) at the customer's home - it is taking care of the animal from 21.00 to 8.00. The price includes 1 walk with the dog, feeding the animal, administration of medicines when needed and fun.
15. When purchasing a Subscription / Package for walking the dog or visiting an animal, the Service Recipient may use the services of the website as part of the package purchased for 365 days from the date of the first walk / first visit. After 365 days from the date of the first walk / visit, the Subscription / Package expires.

16. Taking care of an additional dog or cat at the client's home is free of charge, if it does not include walking the dog.
17. The collection or return of the keys is free of charge in the case of self-delivery / collection by the Customer.
18. Travel beyond the administrative boundaries of the city for presenting services is payable (individual pricing depending on the location).
19. The pricing of other services is individual.
20. In the event of an urgent order (performance of the service within 1-3 hours of the order) or holidays (performance of the service on holidays), an additional fee is charged + 30% to the price of the service.
21. The customer service department at the Alvis pet care service is open from Monday to Sunday from 9:00 to 21:00.
§ 7 DROPPING THE PET
1. The occurrence of the circumstances listed in § 4 point 1.3. is tantamount to the abandonment of the animal by the Owner / Service Recipient and the legal consequences of this event will be considered under the Animal Rights Protection Act of August 21, 1997, which defines the abandonment of an animal as abuse (Article 6 (1) and (2) point 11) And imposes on the Owner a penalty in the form of deprivation or restriction of liberty or a fine (art. 35 sec. 1), where the court may order the animal to be collected (art. 35 sec. 3) and further fate of the animal is regulated by art. 38 of the cited Act.
§ 8 CONTRACT WITHDRAWAL PROCEDURES
1. After the Service Provider fulfills the services described in the Agreement, the Customer loses the right to withdraw from the Agreement.
2. The Parties have the right to withdraw from the Agreement with immediate effect in the event of breach of the provisions set out in the Agreement by the Parties, within 7 days of receiving information about such breach.
3. The Customer, who is a consumer within the meaning of Article 22 [1] of the Civil Code, has the right to withdraw from a distance contract, without giving any reason, by submitting an appropriate statement in writing within 14 days and sending it to the e-mail address alvis @ dog-walk.pl / contact@dog-walk.pl. The 14-day period is counted from the date of the Agreement.
4. The right to withdraw from a distance contract is not available to the consumer in relation to contracts for the provision of services, if the Service Provider has performed the service.
5. In the case of subscription packages, each party has the right to terminate the Agreement with a 7-day notice period.
6. In the event that the Service Recipient, for any reason, does not plan to use the walks / visits purchased in the subscription price and asks the Service Provider for a refund for unused services, the Service Provider has the right to recalculate the costs of the walks / visits in the price of the walk / visit from the appropriate A subscription corresponding to the number of walks / visits used, or for the price of a single walk / visit.
7. The Service Provider will refund the amount paid immediately, no later than 14 days from the date on which the Service Provider received the return / complaint acceptance protocol completed and signed by the Customer (the template of the protocol is in Annex 1 to the Regulations). The Service Provider will refund the payment using a bank transfer to the Customer's account, the data of which the Customer is obliged to provide in the declaration.
8. By accepting the Regulations, the Customer confirms the receipt of information on the right to withdraw from the Agreement.
§ 9 FINAL PROVISIONS
1. The Parties undertake to comply with these Regulations.
2. The Service Provider reserves the right to change the rules and conditions of caring for the animal.
3. In matters not covered by these Regulations, the provisions of the Civil Code shall apply.
4. The Service Recipient agrees to the free placement of photos or videos with the image of his animal in the materials illustrating the Service Provider's operation, including on social networks and on the website https://www.dog-walk.pl.
5. The Regulations are effective from December 18, 2021.
